Arride Graphics' Terms of Use

Please understand that the "Terms of Use" are provided for both your protection and mine; they are written to clarify the terms under which the images contained within this collection may be used. These terms are legally binding.

1. Only the graphics specified within the collection of linkware and desktop wallpapers are permitted to be downloaded, uploaded or placed in another directory; all images that comprise the site itself are the sole, exclusive and permanent property of the artist and may not be reproduced by any method including screen captures and/or downloads.

2. Should you choose to use any graphic found within the linkware collection, whether a complete set or individual image, you must use a linking logo (found on each set selection or on the Link Buttons page) and correct referring link within the same page that the image(s) appear. A text link is permitted. This is not negotiable. Using this logo and link is part of the copyright. Please refer your links to: http://www.arride.com.

A page of "credits" is not acceptable. Please credit my linkware actually on the page(s) of use. Desktop wallpapers and exclusive sets are exempt from the graphic or text linking requirements but referrals to this web site are appreciated.

3. Any site whose intent is to earn revenue (whether actual income and /or bartered for trade) is considered a commercial endeavor. The use of the linkware collection graphics are offered without charge for not-for-profit (e.g. personal), non-profit and commercial or professional web pages or web sites.

Non-profit organizations wishing to use one of the linkware are no longer required to show current proof of your organization's non-profit tax status (or your country's equivalent) or the URL of your current web site.

4. Images from the linkware collection may be used by individuals whose intent in developing web sites for others is for gain (whether actual income and /or bartered for trade) whether from the site itself or from the web page developing service, unless otherwise noted with the set or other linkware graphic.

Use of my images by individuals developing websites with intent to gain is allowed, provided that written acknowledgment from me has been obtained PRIOR to the downloading, uploading or use of any graphic. This written acknowledgment can be in the form of an e-mail.

However, you must still follow the link back guidelines and must clearly state on the web pages where the graphics are from. Taking credit for graphics not created by you constitutes fraudulent representation and an ethical breach between you, your clients and me.

5. Some linkware sets are offered for sale. The sale of a set limits further distribution of the set to others. It does not mean a set is exclusively yours since others may have downloaded the set and are using it on their own web page(s), and it does not mean you own copyrights to the graphics.

In order to comply with terms stated in section 9 below, you will be asked to submit the domain name and nature of the web site these sets will be used on. If your web site does not meet the requirements in section 9, you will be asked to remove the graphics and your money will be refunded.

If, for any reason, you decide not to use the set and wish to be refunded the money paid, it will be done so. But the set will be returned to distribution immediately, reverting back to linkware and available to all once again.

6. You may not alter, change, colorize, resize or modify any or all images without specifically indicated approval with the sole exception of adding text to any supplied blank button or image designed for this purpose.

You may not use any of the images within the linkware collection or any desktop wallpaper to create filters, brushes, tubes, nozzles, fonts or other current or future software plugins.

7. Images within the linkware collection or desktop wallpapers are not to be placed in any online collection or archive. In addition, no images are to be redistributed in any form, e.g. original form or altered, for financial gain or placed within any compilation CD, software or other reproducible media, nor on printed material such as clothing, mugs, mousepads, etc. Those rights are solely mine or that of the artist or creator of images used.

8. Please load the images to your own server or web site directory. Please do not link directly to my images. If you are unsure how to load to your own directory, please consult the upload data on the site service you are using. Web TV users: please use a Web TV Transloader service. Information about this can be found on my Resources page and/or on the set graphics page itself.

9. It is absolutely forbidden to use any piece of the linkware collection or any of the bits-and-pieces (page backgrounds, background tiles, buttons, page dividers, etc.) within web sites or pages promoting child abuse, hate, bigotry, racism, animal abuse, drug use/ abuse and/or illegal or legal pornographic activities.

10. If you use images from the linkware collection, please email me the URL of the completed page or site. I would love to see how the images are used.

11. If for any reason I request that the images from the linkware collection be removed from your site, you will be given 72 hours to comply. Violations of the terms of use could subject you to this request.
